Traveling with Children

Article 313 of the Civil Code of Ukraine stipulates that a person under the age of sixteen years has the right to travel outside Ukraine only with the consent of the parents (adoptive parents), guardians and accompanied by them or persons authorized by them. However, an individual over the age of sixteen has the right to travel independently outside Ukraine.

Departure of the underage citizens of Ukraine from the territory of Ukraine is possible according to one of the following documents:

  • Ukrainian passport for traveling abroad

  • A travel document for a child

  • Ukrainian passport for traveling abroad of a parent accompanying the child across the border, in which, according to the rules, the child’s information is pasted.

  • Birth certificate (children under 16 years):

    • to travel to the Russian Federation;

    • to travel to Moldova and Belarus – for the residents of the administrative border regions traveling through local checkpoints within the administrative border area of residence.

Moreover, Ukrainian citizens traveling outside the territory of Ukraine, who have not attained the age of 16, are carried out only with the consent of both parents and accompanied by them or by persons authorized by them. Such consent is issued by a notary in the form of a declaration addressed to the person who will accompany their child (children) traveling abroad.

Departure of the underage citizens of Ukraine from the territory of Ukraine, accompanied by a parent or by persons authorized by a parent on the notarized agreement is possible according to one of the following:

  • The notarized consent of the other parent, indicating the state of destination and the time period of stay in this state if the other parent is not at a checkpoint at the border.

    Departure of the underage citizens of Ukraine from the territory of Ukraine accompanied by a parent is possible with the oral consent of the other parent, if the latter is at a checkpoint at the border, but should not be crossing the state border and is in possession of documents proving his paternity / maternity (passport, proof of parentage, custody and guardianship).

  • Without a notarized consent of a parent:

    • when the other parent is a foreign or a stateless person, which is confirmed on the birth certificate of the child, and he/she is not at the checkpoint;

    • when there is a corresponding record for permanent residence outside Ukraine or note taking on consular registration in the diplomatic mission of Ukraine abroad in the accompanying person’s passport or child’s travel document;

  • In case there are the original documents or notarized copies present:

    • the death certificate of the other parent;

    • the court decision on deprivation of parental rights of the other parent;

    • the court decision on the recognition of the other parent missing;

    • the court decision on the recognition of the other parent incapacitated;

    • the court decision for permission to travel outside Ukraine without the consent and support of the other parent;

    • the child's birth certificate, issued by Civil Status Registration Office, specifying the grounds for entering information about the father in accordance with the first part of Article 135 of the Family Code of Ukraine (at the time of child’s departure abroad, accompanied by a single mother).

Departure of the underage citizens of Ukraine from the territory of Ukraine accompanied by persons authorized by both parents, carried out by a notarized consent of both parents, indicating the state of destination and the time period of stay in this state.
